Terms & Conditions
In the following terms & conditions “the photographer” Chris Giles trading as Context Photography. “The client(s)” shall be those persons defined as bride and groom on the booking form. These terms and conditions cannot be varied in any way by the client(s) unless such conditions are expressly agreed by the photographer in writing.
Copyright + Ownership:
All digital negatives (computer files) remain the property of the photographer. After the wedding, the photographer will supply a copy of the edited digital images to the client(s) for their own non-commercial use.
Force Majeure
The photographer will endeavour to put the client(s) in touch with another photographer in the event they are unable to attend on the wedding date due to any cause beyond their reasonable control e.g. sudden illness, injury, victim of crime etc. In the event of cancellation by the photographer, or in the very unlikely event of total photographic failure, liability shall be limited to a full refund of any fees paid.
Booking Fee
A non-refundable booking fee of £150 is charged when the client agrees this contract, this fee is deducted (in full) from the total price. The booking fee secures the time and services of the photographer for the wedding and is non-refundable or transferable in the event of cancellation.
Payment
The remaining balance (minus the booking fee) is be due in cleared funds 14 days prior to the date of the wedding day. The photographer agrees that the price stated on the booking form will not be subject to any subsequent rises within the photographer’s pricing structure.
Storage
Original digital images are kept on an active file for 6 months, after which time the raw images are stored in a secure location (access to these images is solely limited to the photographer). Raw image files will not be deleted unless expressly requested to do so by the client.
Personal Accident/ Insurance:
Any directions issued to clients, their guests or employees during a photographic shoot are deemed to be at said persons own risk. The photographer cannot be held responsible for any personal accidents during a photographic shoot. The photographer has full Public liability + Professional indemnity, if you wish to have a copy of my cover then please let me know.
License, Coverage and Reproduction:
Photographs taken during the course of the event will be at the discretion of the photographer although every effort will be made to comply with the clients requirements. The photographer shall endeavour to photograph all individuals as requested by the client(s) at some point. For a booking involving a church ceremony or at certain venues, the photographer’s movements are sometimes restricted by the official in charge. The area from which the photographer is able to cover the ceremony may not be the photographer’s choice and the photographer cannot accept responsibility for any obstructed view should this be the case. Although all equipment is checked regularly and steps are taken to ensure backup equipment is available, the photographer will not be responsible for photographs that are not produced due to technical failure.
